Committee Administrator.  Explains HB 3395 B-5 amendments (EXHIBIT A). Explains the waivers of the Department of Education has granted for statutory timelines, student in existing school and 20% cap on enrollment out of district.

Responds that this was a joint discussion.

Asks Randy Harnish how many waivers were not granted.

Oregon Department of Education.  Responds that these were joint waivers that the State Board looked favorably upon.

Comments on objections to revision and questions who is objecting and for what reason

Governor’s Office.  Explains that the Governor had concerns and could not support the bill as it stood. Believes this will give the State Board of Education a safety valve.

Comments on a constitutional problem.  States that he feels strongly about local control and that he will allow this to move forward reluctantly.

Comments that local control insists that two parties negotiate together.

MOTION:  Moves HB 3395 to the floor with the recommendation that the House CONCUR in Senate amendments dated 5/8/01 and that the bill be FURTHER AMENDED by the –B5 amendments and the measure be REPASSED.
