Committee Administrator.  Gives a brief description of the –B9 amendments (EXHIBIT A), which remove section 4 from the bill.

Darrell Fuller

Oregon Automobile Dealers Association (OADA).  Testifies in support of the –B9 amendments to HB 3917B.  States that the bill in its current form deals with all consumer goods, as opposed to just manufactured dwellings.  Indicates that the measure represents an unintended change to the Unfair Trade Practices Act.  States that the –B9 amendments clarify that the bill deals solely with manufactured housing.

Assistant Attorney General.  Submits informational materials (EXHIBIT B) and expresses support for the –B9 amendments.  References an appeals court case, Coen v. Investment Strategies (1996) relating to the application of the Unfair Trade Practices Act.

MOTION:  Moves HB 3917B to the floor with the recommendation that the House CONCUR in Senate amendments dated 6/19/01 and that the bill be FURTHER AMENDED by the –B9 amendments and the measure be REPASSED.
