Office. Explains that HB 4032 is the
election bill that is needed to get HJR 76 onto the primary election
ballot. It compresses the timelines
to allow normal processes to work for preparation of the ballot title,
explanatory statement, and fiscal statement.
Explains that the HB 4032-1amendments (EXHIBIT D) are needed because of the interest of the Legislative
Assembly in preparing their own ballot title for HJR 76, and at the same time
preserve the process that if the Legislature does not enact its own ballot
title, the attorney general would do it.
The amendments say the attorney general is to go ahead and prepare the
ballot title under the normal processes.
The Elections Division will adopt a rule setting the timelines and
deadlines. The amendments say, in
(5), that even though the attorney general has prepared a ballot title, if the
legislature’s ballot title becomes law not later than March 20, the
legislature’s ballot title wins and is the ballot title for HJR 76. Subsection (6) says if the legislature
does not enact a ballot title by March 21, the title prepared by the attorney
general is the ballot title for HJR 76.
States that the Elections Division has assisted him with the deadlines
but they have not seen this specific language. If changes are needed, they can be made on the Senate side. |
