014	Paul Warner	LFO. Explains the –10 amendment. Changes on page 6 explained. (EXHIBIT A)
023	Sen. Fisher	MOVES the adoption of -10 amendment to substitute for the –9.
030	Sen. Dukes	Asks if a motion to reconsider is needed.
032	Warner	Explains the directions have been to substitute the -10 for the -9.
033	Sen. Dukes	Explains she is going to vote no. Says the voters do not want this.
038	Chair Ferrioli	Explains the choice of a conceptual amendment.
043	Sen. Trow	Does not agree that this is the right amount for this measure. Will vote no on this. Asks to delay the bill.
066	Chair Ferrioli	Replies the committee waited 20 minutes. Says the Republican caucus will consider this as a catalyst to move to the floor. There will be ample time for discussion. Since there has been an impasse for a few days, the issue needs to move forward.
083	Sen. Trow	Emphasizes there is need for a pause before action is taken.
	Chair Ferrioli	Says the request to delay is under advisement.
091	Chair Ferrioli	Continues the endowment fund is critical to budget and to the education community. The question is an issue of choosing the right number. Excuses himself for a few minutes and hands gavel to Sen. Minnis.
123	Sen. Minnis	Discusses the amounts proposed in the fund. Says this will go to a conference committee.
125	Warner	Explains that the -9 amendments are contained in the -10 amendments which are merely reference changes. The substantive change in the -10 amendments is to change the amount from 180 to 220.
140	Sen. Minnis	Explains that there are not votes for some of the tax increase proposals.
144	Sen. Dukes	Agrees with Sen. Trow. Says they will be resolved in conference committee. Does not agree with the process. The democrats want a chance to meet and talk and come to conclusions.
169	Sen. Minnis	Comments that bills can be moved back to committees.
161	Sen. Fisher	Comments that Oregon is not recovering from the recession very fast. Wants to support education but they must use their means as far as possible. Asks for cooperation from recipients of funding.
181	Sen. Trow	Comments that the democrats have been working on the proposal presented by the Senate President. Says this bill is a key part of a solution and the democrats need more time to consider a counter proposal.
207	Sen. Minnis	Calls five minute recess at 1:35. Chair Ferrioli returns.

219	Sen. Dukes	This bill was not originally a stand alone bill, is that correct?
220	Chair Ferrioli	Answers there are probably four bills that relate to this bill.
221	Sen. Dukes	Asks why they are not all being done at once.
222	Chair Ferrioli	Answers the bills will be returned to over and over. To make this bill effective, the other bills would have to be modified. This bill will become a part of policy and a catalyst for discussion.

HJR 80 – WORK SESSION
288	Sen. Minnis	MOTION: Moves to RECONSIDER the vote by which the committee passed HJR 80 to the floor do pass as amended.
300	Sen. Dukes	Asks about vote required. Is 2/3 required?
301	Committee Members	Discussion about vote requirements. Chair Ferrioli clarifies that since this reconsideration is within the same day in the same committee, a simple majority is correct.
322		VOTE: 5-0
323	Chair Ferrioli	Hearing no objection, declares the motion CARRIED.
327	Chair Ferrioli	Asks Legisative Counsel to explain amendments.
328	Cindy Hunt	Legislative Counsel. Says the –A11 amendments (EXHIBIT B) are a “gut and stuff” and restores the measure to its original introduced form. Says the measure will no longer be a constitutional revision, so the vote requirement will be a simple majority. Details components of amendments.
338	Sen. Trow	Asks about purpose of amendments is to reduce vote requirements.
340	Hunt	Responds the amendments are one subject so the higher vote standard does not apply..
342	Sen. Trow	Clarifies they need 16 votes to pass HJR 80 with the new amendments.
345	Hunt	Responds yes. Further clarifies that the dollar amount is changed to $220 million.
348	Chair Ferrioli	Says the bill will likely go to conference committee.
350	Sen. Trow	Asks about the capital construction fund.
360	Chair Ferrioli	Says this will be a stand alone bill.
370	Sen. Dukes	Asks why the funds are transferred on May 1. Questions how this will help schools make decisions if it is at the end of the school year
TAPE 14, A
007	Warner	Clarifies the transfer will take place at the same time as the May 15 final payment. Says keeping the moneys in the fund will generate interest earnings.
015	Sen. Dukes	Asks if this will help schools.
017	Warner	Responds it will be part of their fiscal year.
020	Sen. Dukes	Opines this will be better timing for the legislature.
023	Sen. Trow	And also for some of the funds that work on the interest from that fund. Like the grants going to college students and so forth. There will be more of those because there will be more interest.
025	Sen. Dukes	Asks if this is backed by tobacco settlement funds.
026	Warner	Responds that is in another bill.
027	Chair Ferrioli	Responds that other bills will be scheduled soon.
034	Sen. Dukes	Asks if it is his intention to provide a back up for HJR 80.
037	Sen. Minnis	MOTION: Moves to ADOPT HJR 80-A11 amendments dated 6/18/02.
