Committee Administrator.  Explains the difference between the House and Senate versions of HB 2458, noting their different approaches to a sunset clause and commercial development.  Introduces the –B8 amendments (EXHIBIT A) and explains they would repeal the sunset.  Makes correction on the staff measure summary.

Asks Sen. Ringo to review the –B8 amendments.

Explains the removal of the commercial provision and discussions around the sunset.  Notes the small amount of land involved.

Appreciates the Senate’s consideration of economic development in rural Oregon.  Understands the exclusion of the Willamette Valley.  Admits that there is disappointment in the removal of the commercial provision but is willing to accept the amendments.  Notes possibility to look at this issue in the future.  Generally supports the –B8 amendments.

Reports his support of the amendments and notes discussions in the budget committee.

References the letter from the Governor’s office (EXHIBIT B) which issues support for HB 2458B without further amendments.  Reports his intention to vote no.  Discusses the issue of certainty and asks why a sunset would inhibit development.  Notes good policy arguments on both sides.

Senior Staff Attorney, Oregon Association of Realtors.  Speaks in supports of the –B8 amendments.  Counters a point in the Governor’s letter, noting it would not authorize “unlimited industrial development” and outlines other provisions which would limit development.

Comments on confusion in the sentence.  Asks the panel about the issue of certainty.

Discusses the issue of certainty relating to how property owners are able to use their land.  Gives an example of lost sales due to uncertainty and comments on the area’s competition with Washington.

Director, Department of Land Conservation and Development (DLCD).  Discusses the department’s actions to resolve this issue.

Asks how many sites have been certified.

 

Shetterly

Replies 25.  Gives examples of the department’s support of industrial development in rural Oregon.  Describes this legislation as broad.  Addresses the certainty issue and describes the department’s intent to be finished with their work before the proposed sunset would expire.
