Caption: Repeal of rule establishing
agency payment for steel escalation.
Order No.: DOT 3-2011
Filed with Sec. of
Certified to be
Rules Repealed: 731-007-0335
Subject: In 2005, HB 2077 required ODOT to adjust the amount
paid to a highway construction contractor when steel material delivered to the
contractor was more than 10 percent above the price quoted in the contractor’s
original bid. OAR 731-007-0335 established the process for making payments to
contractors for the unanticipated escalation in the cost of steel materials
contained a deadline of January 2, 2010 for submission of contractor claims.
Because the deadline has passed, the rule was repealed.
