Present Duties
The Psychiatric Security Review Board (PSRB) was created in 1978 to assume jurisdiction over persons in Oregon found to be “guilty except for insanity” of a crime. The board’s jurisdiction is equal to the maximum sentence provided by statute for such a crime. In 2005, the Legislature created a juvenile panel of the PSRB to assume jurisdiction over youths who are found “responsible except for insanity” of a crime. Both panels protect the public through ongoing review of the progress of those placed under its jurisdiction and a determination of their appropriate placement.
The ten board members are appointed by the governor and confirmed by the Senate for four-year terms. The board has authority to commit a person to a state hospital designated by the Department of Human Services or, in the case of a youth, to a secure adolescent inpatient rehab program; conditionally release a person from a state hospital or secure facility to a community-based program with close supervision; discharge a person from its jurisdiction; and, when appropriate, revoke the conditional release of a person under its jurisdiction and order the person’s return to a state hospital or secure adolescent inpatient rehab program.
In 2009, new legislation was enacted requiring that the PSRB provide information to the Oregon State Police (OSP) on all persons who have been under the PSRB’s jurisdiction for the last 20 years, and then to continue providing OSP with information on persons placed under the PSRB thereafter, for purposes of updating the national database for those prohibited from possessing a firearm.
