The Psychiatric Security Review Board (PSRB) was created in 1978 to assume responsibility and jurisdiction over persons who successfully assert the insanity defense to a crime, also known as being found “guilty except for insanity.” The juvenile panel under the PSRB was created in 2005 to assume jurisdiction over youths found “responsible except for insanity.” With public safety as its mission, the multi-discipline board has 10 members who are appointed by the governor and confirmed by the Senate to four-year terms. The board has authority to commit a person to the state hospital or a secure adolescent inpatient rehabilitation program, conditionally release a person from a state hospital or secure facility to a community-based program with close supervision, discharge a person from its jurisdiction, and, when appropriate, revoke the conditional release of a person under its jurisdiction and order the person’s return to a state hospital, secure facility or inpatient program. Both the adult and juvenile panels of the PSRB monitor the status of those placed under its jurisdiction and determine their appropriate placement.
In 2009, in order to keep the national database updated for those prohibited from possessing a firearm due to a mental health determination, the PSRB was tasked with creating a records reconciliation program and establishing a relief program for those requesting restoration of their firearm privileges. In 2013, the board received additional responsibilities that included establishing risk classifications for registered sex offenders under its jurisdiction and establishing a relief/reclassification process. In 2014, the PSRB was also given supervisory responsibility for persons determined by the courts to meet the criteria of civil commitments.
The PSRB employs 11 people, including an executive director and support staff, and is based in Portland. It also conducts regular hearings in Salem.
